Kiraya verenin, s\u00f6zle\u015fme s\u00fcresi i\u00e7inde veya an\u0131lan uzama s\u00fcresi dolmadan kira s\u00f6zle\u015fmesini kirac\u0131n\u0131n r\u0131zas\u0131 olmaks\u0131z\u0131n sona erdirebilmesi i\u00e7in tahliye davas\u0131 a\u00e7mas\u0131 gerekmektedir. Kiraya verenin a\u00e7abilece\u011fi tahliye davas\u0131 ise belirli tahliye sebepleri ile s\u0131n\u0131rland\u0131r\u0131lm\u0131\u015f olup bu sebepler d\u0131\u015f\u0131ndaki bir sebeple a\u00e7\u0131labilmesi m\u00fcmk\u00fcn de\u011fildir. Ayr\u0131ca kanunda say\u0131lan tahliye sebepleri d\u0131\u015f\u0131ndaki bir durumun s\u00f6zle\u015fme ile tahliye sebebi olarak kararla\u015ft\u0131r\u0131lmas\u0131 da m\u00fcmk\u00fcn de\u011fildir (TBK m. 354).<\/p><p>Kiraya verenin ihtiyac\u0131 sebebiyle kiralanan\u0131n tahliyesi, TBK\u2019da \u00f6ng\u00f6r\u00fclen, kiraya verenden kaynaklanan tahliye sebeplerinden biridir. S\u00f6z konusu tahliye sebebi, kiraya verene tan\u0131nm\u0131\u015f bir hak olup bu hakk\u0131n dava yoluyla kullan\u0131lmas\u0131 gerekmektedir.<\/p><p><b>TBK\u2019da yer alan ilgili h\u00fck\u00fcm a\u015fa\u011f\u0131daki gibidir;<\/b><\/p><p><strong>TBK m. 350<\/strong>:<em> \u201cKiraya veren, kira s\u00f6zle\u015fmesini;\u00a0<\/em><em style=\"font-size: 14px;\">Kiralanan\u0131 kendisi, e\u015fi, altsoyu, \u00fcstsoyu veya kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu di\u011fer ki\u015filer i\u00e7in konut ya da i\u015fyeri gereksinimi sebebiyle kullanma zorunlulu\u011fu varsa,\u00a0<\/em><em style=\"font-size: 14px;\">(\u2026) belirli s\u00fcreli s\u00f6zle\u015fmelerde s\u00fcrenin sonunda, belirsiz s\u00fcreli s\u00f6zle\u015fmelerde kiraya ili\u015fkin genel h\u00fck\u00fcmlere g\u00f6re fesih d\u00f6nemine ve fesih bildirimi i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcreler uyularak belirlenecek tarihten ba\u015flayarak bir ay i\u00e7inde a\u00e7aca\u011f\u0131 dava ile sona erdirebilir.\u201d\u00a0\u00a0<\/em><\/p><p><strong>Kanun h\u00fckm\u00fcnden hareketle, kiraya verenin ihtiyac\u0131 sebebiyle a\u00e7t\u0131\u011f\u0131 dava sonucunda kiralanan\u0131n tahliyesinin ger\u00e7ekle\u015febilmesi baz\u0131 \u015fartlar\u0131n sa\u011flanmas\u0131na ba\u011fl\u0131d\u0131r: <\/strong><\/p><ol><li>Kiraya verenin kendisinin, e\u015finin, altsoyunun, \u00fcstsoyunun veya kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu di\u011fer ki\u015filerin kiralanan\u0131 konut ya da i\u015fyeri olarak kullanma gereksiniminin olmas\u0131,<\/li><li>Kiralanan\u0131 konut veya i\u015fyeri olarak kullanma ihtiyac\u0131n\u0131n ger\u00e7ek ve samimi olmas\u0131,<\/li><li>Kiraya verenin kirac\u0131ya kar\u015f\u0131 kiralanan\u0131 konut veya i\u015fyeri olarak kullanma ihtiyac\u0131 sebebiyle tahliye davas\u0131 a\u00e7mas\u0131,<\/li><li>Kiraya verenin a\u00e7aca\u011f\u0131 tahliye davas\u0131n\u0131n belirli s\u00fcreli s\u00f6zle\u015fmelerde s\u00fcrenin sonunda, belirsiz s\u00fcreli s\u00f6zle\u015fmelerde kiraya ili\u015fkin genel h\u00fck\u00fcmlere g\u00f6re fesih d\u00f6nemine ve fesih bildirimi i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcrelere uyularak belirlenecek tarihten ba\u015flayarak bir ay i\u00e7inde a\u00e7mas\u0131,<\/li><li>Kiraya verenin, en ge\u00e7 davan\u0131n a\u00e7\u0131lmas\u0131 i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcrede dava a\u00e7aca\u011f\u0131n\u0131 kirac\u0131ya yaz\u0131l\u0131 olarak bildirmesi halinde dava a\u00e7ma s\u00fcresi bir kira y\u0131l\u0131 i\u00e7in uzam\u0131\u015f say\u0131lacakt\u0131r (TBK m.353). Ancak kiraya verenin kiralanan\u0131 konut veya i\u015fyeri olarak kullanma ihtiyac\u0131n\u0131n yaz\u0131l\u0131 bildirim an\u0131nda s\u00f6z konusu olmal\u0131d\u0131r<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a>.<\/li><\/ol><p>Tahliye davas\u0131n\u0131n a\u00e7\u0131lmas\u0131 taraflar aras\u0131ndaki kira s\u00f6zle\u015fmesini sona erdirmez. Bu sebeple, taraflar s\u00f6zle\u015fmede kararla\u015ft\u0131r\u0131lan y\u00fck\u00fcml\u00fcl\u00fcklerine yerine getirmeye devam edeceklerdir. Kirac\u0131 davan\u0131n kesinle\u015fece\u011fi ana kadar kararla\u015ft\u0131r\u0131lan kira \u00f6deme borcunu yerine getirmekle, kiraya veren ise kiralanan\u0131 kullan\u0131ma elveri\u015fli bir durumda bulundurmakla y\u00fck\u00fcml\u00fcd\u00fcr.<\/p><p>Kiralanan\u0131n, kiraya verenin gereksinimi sebebiyle tahliyesi durumunda kiraya veren, ilgili ta\u015f\u0131nmaz\u0131n\u0131 TBK m.355 uyar\u0131nca hakl\u0131 sebep olmaks\u0131z\u0131n, 3 (\u00fc\u00e7) y\u0131l ge\u00e7medik\u00e7e eski kirac\u0131s\u0131ndan ba\u015fkas\u0131na kiralayamaz. Kiralamas\u0131 durumunda ise kiraya verenin eski kirac\u0131s\u0131na son kira y\u0131l\u0131nda \u00f6denmi\u015f olan bir y\u0131ll\u0131k kira bedelinden az olmamak \u00fczere tazminat \u00f6demekle y\u00fck\u00fcml\u00fc hale gelecektir.<\/p><p><a href=\"#_ftnref1\" name=\"_ftn1\">[1]<\/a> Cevdet Yavuz\/Faruk Acar\/Burak \u00d6zen, Bor\u00e7lar Hukuku Dersleri (\u00d6zel H\u00fck\u00fcmler), 14.
