Genel Olarak<\/strong><\/h3>\n\n<p>Markalar aras\u0131 benzerli\u011fin\/ayn\u0131l\u0131\u011f\u0131n ya da mal\/hizmetler aras\u0131ndaki benzerli\u011fin al\u0131c\u0131lar\u0131 sat\u0131n almay\u0131 d\u00fc\u015f\u00fcnd\u00fckleri mal yerine ba\u015fka bir mal\u0131 almaya y\u00f6nlendirmesi veyahut al\u0131c\u0131lar\u0131n iki markan\u0131n farkl\u0131 olduklar\u0131n\u0131 bilmelerine ra\u011fmen markalar\u0131n ayn\u0131 firmaya ait oldu\u011funu d\u00fc\u015f\u00fcnmeleri ya da i\u015fletmesel k\u00f6ken olarak firmalar aras\u0131nda bir ba\u011flant\u0131 oldu\u011fu d\u00fc\u015f\u00fcncesine kap\u0131lmalar\u0131, markalar aras\u0131ndaki kar\u0131\u015ft\u0131r\u0131lma tehlikesini g\u00fcndeme getirmektedir.<\/p>\n\n<p>Markalar\u0131n ayn\u0131 olmad\u0131\u011f\u0131n\u0131n al\u0131c\u0131lar taraf\u0131ndan fark edilmesine ra\u011fmen ayn\u0131 i\u015fletmeye ait olduklar\u0131n\u0131n d\u00fc\u015f\u00fcn\u00fclmesi <strong>do\u011frudan kar\u0131\u015ft\u0131r\u0131lma tehlikesi,<\/strong> marka ve i\u015fletmelerin ayn\u0131 i\u015fetmeye ait olmad\u0131\u011f\u0131n\u0131n fark\u0131nda olunmas\u0131na ra\u011fmen i\u015fletmelerin bir \u015fekilde ba\u011flant\u0131l\u0131 oldu\u011funun d\u00fc\u015f\u00fcn\u00fclmesi ise <strong>dolay\u0131 kar\u0131\u015ft\u0131r\u0131lma tehlikesidir<\/strong>. Kanunda bu y\u00f6nde bir ayr\u0131m yap\u0131lmam\u0131\u015f olmamas\u0131na ra\u011fmen her iki durum da kanun anlam\u0131nda kar\u0131\u015ft\u0131r\u0131lma ihtimali kapsam\u0131nda g\u00f6r\u00fclmektedir.<\/p>\n\n<p>Kar\u0131\u015ft\u0131r\u0131lma ihtimali, bir marka i\u00e7in tescil ba\u015fvurusu yap\u0131lmas\u0131 halinde \u00f6nceki tescilli marka sahibine itiraz hakk\u0131 vermesinin yan\u0131nda ayn\u0131 zamanda markan\u0131n h\u00fck\u00fcms\u00fczl\u00fc\u011f\u00fc sebeplerinden (SMK m.25\/1) ve markaya tecav\u00fcz hallerinden (SMK m.29\/1) birisini te\u015fkil eder. Marka tescili ba\u015fvurular\u0131nda, tescile kar\u015f\u0131 yap\u0131lan itirazlar \u00e7o\u011funlukla kar\u0131\u015ft\u0131r\u0131lma ihtimaline dayan\u0131larak yap\u0131lmas\u0131ndan \u00f6t\u00fcr\u00fc bu \u00e7al\u0131\u015fmada, kar\u0131\u015ft\u0131r\u0131lma ihtimali sadece SMK m.6\/1-b uyar\u0131nca nispi tescil engeli olarak incelenecektir.<\/p>\n\n<h3 class=\"wp-block-heading\"><strong>2. Kar\u0131\u015ft\u0131r\u0131lma \u0130htimalinin \u0130ncelenmesi<\/strong><\/h3>\n\n<p>Kar\u0131\u015ft\u0131r\u0131lma ihtimali uyar\u0131nca tescili talep edilen marka ba\u015fvurusunun reddedilmesi veya tescili kabul edilen markan\u0131n sicilden terkin edilebilmesi i\u00e7in 6769 say\u0131l\u0131 S\u0131nai M\u00fclkiyet Kanunu m.6\/1 de say\u0131lan \u015fartlar\u0131n somut olayda ger\u00e7ekle\u015fmi\u015f olmas\u0131 gerekmektedir. Bu \u015fartlar \u015funlard\u0131r;<\/p>\n\n<ul class=\"wp-block-list\" type=\"a\">\n<li>Tescil ba\u015fvurusu yap\u0131lan marka, tescil edilmi\u015f veya \u00f6nceki tarihte ba\u015fvurusu yap\u0131lm\u0131\u015f bir marka ile ayn\u0131 ya da benzer olmas\u0131,<\/li>\n<li>Tescil ba\u015fvurusu yap\u0131lan marka ile tescil edilmi\u015f veya \u00f6nceki tarihte ba\u015fvurusu yap\u0131lm\u0131\u015f bir markan\u0131n kapsad\u0131\u011f\u0131 mal veya hizmetlerin ayn\u0131 ya da benzer olmas\u0131.<\/li>\n<\/ul>\n\n<p>\u00d6nemle belirtmek gerekir ki kar\u0131\u015ft\u0131r\u0131lma ihtimalinin mevut olmas\u0131 i\u00e7in aranan yukar\u0131daki \u015fartlar\u0131n her ikisinin birlikte somut olayda sa\u011flanm\u0131\u015f olmas\u0131 gerekmektedir. Ba\u015fka bir deyi\u015fle, \u015fartlardan herhangi birinin sa\u011flanmam\u0131\u015f olmas\u0131 kar\u0131\u015ft\u0131r\u0131lma ihtimalini ortadan kald\u0131racakt\u0131r.<\/p>\n\n<p>Yukar\u0131da say\u0131lan \u015fartlar \u0131\u015f\u0131\u011f\u0131nda kar\u0131\u015ft\u0131r\u0131lma ihtimalinin mevcut olabilece\u011fi fark\u0131 ihtimaller \u015fu \u015fekilde grupland\u0131r\u0131labilir:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Tescilli markan\u0131n <strong>ayn\u0131n\u0131n, ayn\u0131 mal\/hizmet<\/strong> i\u00e7in tescilinin talep edilmesi,<\/li>\n<li>Tescilli markan\u0131n <strong>ayn\u0131n\u0131n, benzer mal\/hizmet<\/strong> i\u00e7in tescilinin talep edilmesi,<\/li>\n<li>Tescilli markan\u0131n <strong>benzerinin, ayn\u0131 mal\/hizmet<\/strong> i\u00e7in tescilinin talep edilmesi,<\/li>\n<li>Tescilli markan\u0131n <strong>benzerinin, benzer mal\/hizmet<\/strong> i\u00e7in tescilinin talep edilmesi.<\/li>\n<\/ul>\n\n<h5 class=\"wp-block-heading\"><strong>a. Markalar Aras\u0131nda Ayniyet veya Benzerli\u011fin Bulunmas\u0131<\/strong><\/h5>\n\n<p>Markalar\u0131n birbirinin ayn\u0131s\u0131 olmas\u0131 i\u00e7in \u015fekil, kelime, resim, renk vb. detaylar\u0131n birebir ayn\u0131 olmas\u0131 gerekmektedir. Bu detaylardan birinin farkl\u0131 olmas\u0131 markalar\u0131 ayn\u0131 olmaktan \u00e7\u0131kar\u0131p benzerli\u011fi g\u00fcndeme getirecektir.<\/p>\n\n<p>Markalar aras\u0131nda benzerlik incelemesinde <strong>markalar\u0131n bir b\u00fct\u00fcn olarak halkta b\u0131rakt\u0131\u011f\u0131 intiba<\/strong>, <strong>etki<\/strong> dikkate al\u0131n\u0131r. Bu kapsamda markalar par\u00e7alar\u0131na b\u00f6l\u00fcnerek unsurlar\u0131 tek ba\u015f\u0131na ele al\u0131nmamal\u0131d\u0131r. Benzerlik incelemesinde, markalar\u0131n g\u00f6rsel, i\u015fitsel, fonetik durumlar\u0131 ve anlamlar\u0131n\u0131n bir b\u00fct\u00fcn olarak veya birka\u00e7\u0131n\u0131n meydana getirdi\u011fi benzerlik sonucu halk\u0131n iki markay\u0131 kar\u0131\u015ft\u0131r\u0131p kar\u0131\u015ft\u0131rmayaca\u011f\u0131 incelenmektedir. Bu noktada dikkate al\u0131nacak olan halk, ilgili markan\u0131n kapsad\u0131\u011f\u0131 <strong>mal veya hizmetlerin<\/strong> <strong>potansiyel m\u00fc\u015fteri kitlesine g\u00f6re belirlenecek ortalama t\u00fcketicidir<\/strong><a href=\"#_ftn1\">[1]<\/a>.<\/p>\n\n<p>Benzerlik incelemesinde dikkat edilecek bir di\u011fer \u00f6nemli husus ise markan\u0131n ay\u0131rt edicilik niteli\u011finin bulunup bulunmamas\u0131d\u0131r. Markan\u0131n ay\u0131rt edicilik d\u00fczeyi artt\u0131k\u00e7a, sonraki benzer marka ile kar\u0131\u015ft\u0131r\u0131lma ihtimali de o d\u00fczeyde artacakt\u0131r. Tescil edildi\u011fi mal\/hizmetler ile yak\u0131nl\u0131k i\u00e7inde olmas\u0131 ya da g\u00fcnl\u00fck hayatta s\u0131k\u00e7a herkes taraf\u0131ndan herhangi bir yerde kullan\u0131lan s\u0131radan s\u00f6zc\u00fck olmas\u0131 markalar\u0131n ay\u0131rt edicilik d\u00fczeyini zay\u0131flat\u0131rken, markan\u0131n kelime unsurlar\u0131n\u0131n anlams\u0131z olmas\u0131, kapsad\u0131\u011f\u0131 mal\/hizmetlerle yak\u0131n olmamas\u0131 vb. durumlar ise markan\u0131n ay\u0131rt edicilik d\u00fczeyini art\u0131rmaktad\u0131r<a href=\"#_ftn2\">[2]<\/a>.<\/p>\n\n<h5 class=\"wp-block-heading\"><strong>b. Mal veya Hizmetler Y\u00f6n\u00fcnden Ayniyet veya Benzerli\u011fin Bulunmas\u0131<\/strong><\/h5>\n\n<p>Kar\u0131\u015ft\u0131r\u0131lma ihtimalinin ikinci \u015fart\u0131 ise markalar\u0131n kapsad\u0131\u011f\u0131 mal\/hizmetlerin ayn\u0131 veya benzer olmas\u0131d\u0131r. T\u00fcrk marka hukukunda s\u0131n\u0131f sistemi kabul edilmi\u015f olup tescilli markalara tescil edildi\u011fi s\u0131n\u0131flardaki mallarla s\u0131n\u0131rl\u0131 olacak \u015fekilde koruma sa\u011flanmaktad\u0131r. Markalar\u0131n kapsad\u0131\u011f\u0131 mallar, bu sistem uyar\u0131nca T\u00fcrk Patent ve Marka Enstit\u00fcs\u00fc taraf\u0131ndan Nice Anla\u015fmas\u0131 esas al\u0131narak yay\u0131mlanan S\u0131n\u0131fland\u0131rma Tebli\u011fi\u2019ndeki<a href=\"#_ftn3\">[3]<\/a> s\u0131n\u0131flara g\u00f6re belirlenmektedir. Mal ve hizmetlerin ayn\u0131 veya benzer olup olmad\u0131\u011f\u0131 da ilgili markalar\u0131n tescil edildi\u011fi s\u0131n\u0131flar dikkate al\u0131narak yap\u0131lmaktad\u0131r.<\/p>\n\n<p>S\u0131n\u0131fland\u0131rma tebli\u011finde yer alan s\u0131n\u0131flarda, alt s\u0131n\u0131flar bulunup markalar bu alt s\u0131n\u0131flardaki mallarla s\u0131n\u0131rl\u0131 olarak tescil edilebilir. Bu do\u011frultuda, ayn\u0131 s\u0131n\u0131fta fakat farkl\u0131 alt s\u0131n\u0131flarda tescil edilmi\u015f markalar aras\u0131nda mal\/hizmet bak\u0131m\u0131ndan ayn\u0131l\u0131k veya benzerli\u011fin bulundu\u011fu s\u00f6ylenemez.<\/p>\n\n<p>\u00d6nemle belirtmek gerekir ki, T\u00dcRKPATENT\u2019in yay\u0131mlad\u0131\u011f\u0131 S\u0131n\u0131fland\u0131rma Tebli\u011fi ba\u011flay\u0131c\u0131 olmay\u0131p markalar\u0131n kapsad\u0131\u011f\u0131 mal veya hizmetin ayn\u0131 oldu\u011funa dair karine niteli\u011findedir<a href=\"#_ftn4\">[4]<\/a>. Bu kapsamda mallar\u0131n veya hizmetlerin benzer olup olmad\u0131\u011f\u0131n\u0131n tespitinde mallar\u0131n al\u0131c\u0131 \u00e7evresinin farkl\u0131 olup olmad\u0131\u011f\u0131, benzer ihtiya\u00e7lar\u0131 kar\u015f\u0131lay\u0131p kar\u015f\u0131lamad\u0131\u011f\u0131, aralar\u0131nda hammaddde-mam\u00fcl \u00fcr\u00fcn ili\u015fkisi bulunup bulunmad\u0131\u011f\u0131, birbirlerinin yerine ikame edilip edilemeyece\u011fi, sat\u0131\u015flar\u0131n\u0131n ayn\u0131 yerde yap\u0131l\u0131p yap\u0131lmayaca\u011f\u0131, hedef kitlelerinin farkl\u0131 olup olmad\u0131\u011f\u0131n\u0131n de\u011ferlendirilmesi gerekmektedir<a href=\"#_ftn5\">[5]<\/a>. T\u00fcm bu fakt\u00f6rlerin incelenmesi neticesinde farkl\u0131 s\u0131n\u0131flarda yer alan mal\/hizmetler, benzer mal oldu\u011funa karar verilebilmektedir.<\/p>\n\n<h3 class=\"wp-block-heading\"><strong>3.<\/strong> <strong>Sonu\u00e7<\/strong><\/h3>\n\n<p>Kar\u0131\u015ft\u0131r\u0131lma ihtimali, bir markan\u0131n tescili i\u00e7in yap\u0131lan ba\u015fvurulara kar\u015f\u0131 ileri s\u00fcr\u00fclen itirazlarda en \u00e7ok dayan\u0131lan nispi ret sebebidir. Bu nispi ret sebebine dayanarak bir markan\u0131n tescil ba\u015fvurusunun reddedilebilmesi i\u00e7in itiraz edenin tescilli markas\u0131 ile tescili talep edilen markan\u0131n ayn\u0131 veya benzer olmas\u0131 ve s\u00f6z konusu markalar\u0131n kapsad\u0131\u011f\u0131 mal\/hizmetlerin ayn\u0131 ya da benzer olmas\u0131 gerekmektedir. Bu iki \u015fart\u0131n bir arada sa\u011flanmas\u0131 halinde, kar\u0131\u015ft\u0131r\u0131lma ihtimalinin mevcudiyetinden s\u00f6z edilebilir. Aksi durumda, say\u0131lan \u015fartlardan birinin sa\u011flanmamas\u0131, kar\u0131\u015ft\u0131r\u0131lma ihtimalini ortadan kald\u0131racakt\u0131r. Markalar\u0131n benzer veya ayn\u0131 olup olmad\u0131\u011f\u0131 incelenirken markay\u0131 olu\u015fturan unsurlar\u0131n g\u00f6rsel, i\u015fitsel, fonetik ve anlam bak\u0131m\u0131ndan bir b\u00fct\u00fcn olarak ele al\u0131n\u0131p al\u0131c\u0131lar \u00fczerinde b\u0131rakt\u0131\u011f\u0131 etki dikkate al\u0131nmaktad\u0131r.
